GLOBALPRENEURS Policies and Procedures governing Distributors are outlined below. Take time to read the entire document to fully understand the Policies and Procedures.
GLOBALPRENEURS Statement of Operating Philosophy
The Founders of GLOBALPRENEURS believe in leadership by example rather than management by directive. GLOBALPRENEURS leadership has demonstrated a high degree of integrity and success in sales and corporate management. As such, they are committed to the following principles and standards as an integral part their business. They are committed to following the Ten Common Sense Principles of "Great Management Practice" and use these principles in the daily management of their business. For purposes of these Policies and Procedures, GLOBALPRENEURS, its parent, and affiliates shall be referred to as "GLOBALPRENEURS". We refer to our distributors as a Globalpreneurs (meaning a Global Entrepreneur), Distributors or Independent Distributors.
Commitment to Excellence
The GLOBALPRENEURS corporate management team is committed to completely supporting its Distributors and their Customers by providing quality service with accurate and timely reporting and timely response to their questions and concerns. GLOBALPRENEURS has set these goals to give each Independent Distributor the best opportunity to develop a successful business. GLOBALPRENEURS will not exclude anyone from this distribution opportunity based on race, age, sex, national origin, religion, disability or any other similar grounds prescribed or otherwise prohibited by law.
GLOBALPRENEURS believes that Distributors should be able to expect long-term income from their efforts. To this end, GLOBALPRENEURS strives for excellence in the following ways:
- By maintaining the highest degree of integrity at every level of the company. Our intent is to completely delight every Distributor and each of their Customers.
- By offering the highest quality services and products at competitive prices and communicating regularly with our Distributors and their Customers using high-tech / high-touch personalized electronic communication.
- By providing prompt, courteous service to our Distributors and their Customers from an online support team at GLOBALPRENEURS
Independent Customer Rights and Obligations
- Ethics
GLOBALPRENEURS conducts its business in an ethical manner and requires its Distributors to deal ethically with their Customers, with each other, and with the Company.
GLOBALPRENEURS permits no unethical or illegal activity and will take immediate action should such behavior occurs.
GLOBALPRENEURS reserves the right to use its best judgment in deciding whether certain Distributor's activities are unethical. Furthermore, GLOBALPRENEURS may use its own discretion in determining the appropriate course of action.
If GLOBALPRENEURS determines that unethical activities have occurred, then it reserves the right to suspend or terminate the Independent Distributor status, including, but not limited to, all commissions and payments of any kind. Under no circumstances would an Independent Distributor, who is terminated for unethical or illegal activity, be entitled to sell or transfer her or his position.
It is the company policy to issue one written warning before taking any action to terminate any Distributor. That Distributor will be given an opportunity to immediately cease any unethical or illegal activity and may appeal to the GLOBALPRENEURSAdvisory team. They have the final vote prior to termination of a Distributor.
EXAMPLES OF UNETHICAL OR ILLEGAL ACTIVITY INCLUDE, BUT ARE NOT LIMITED TO:
- Forging a signature on any document;
- Making false or misleading representations of any kind including, but not limited to, misrepresentations about GLOBALPRENEURS services or the GLOBALPRENEURS Compensation Plan;
- Depositing checks made payable to GLOBALPRENEURS into personal accounts instead of immediately forwarding them to GLOBALPRENEURS.
- Cross-line recruiting: A GLOBALPRENEURS Independent Distributor may not solicit an individual or entity that has been previously sponsored or entice any existing Distributor to resign their position and re-join the company under their organization. Should the above occur, the original Distributor must resign and remain inactive for a period of 6 months before being re-recruited by a different Distributor. Any Distributor who personally invites a guest to any company live presentation, video conference call or telephone conference call and can verify their attendance, as their guest, will be protected for a period of 30 days from being enrolled by any other Distributor.
After 30 days from the date of being a verified guest and they have not joined the company, they are no longer obligated to join under the original inviting Distributor. Ultimately the decision for a guest to pick his enroller of choice remains the decision of the guest.
GLOBALPRENEURS Distributors may not solicit a GLOBALPRENEURS Independent Distributor, who is not in their down-line organization, into any other business opportunity. This is considered unethical by Globalpreneurs management team.
However, the GLOBALPRENEURS Management team is very much in favor of multiple sources of income and has no problem with any Distributor offering non-competitive products or service opportunities that are not in direct competition with Globalpreneurs products or service offerings.
- Spreading false or misleading remarks or rumors with malicious intent that may disparage GLOBALPRENEURS its employees, or another GLOBALPRENEURS Independent Distributor.
- Any unauthorized use of Globalpreneurs name, trademarks, or copyrighted material (i.e. reproducing Globalpreneurs forms, business cards, etc.);
- Violation of any federal, state or local laws or regulations; GLOBALPRENEURS Distributors are prohibited from third party solicitation by telemarketing, direct mail, sweepstakes, contests, and drawings. GLOBALPRENEURS only authorizes sales by means of direct, personal solicitation of Distributors. This does not prohibit authorized advertising by Distributors in any media that is pre-approved by Globalpreneurs Management team. All such campaigns must be submitted in writing for approval prior to being implemented.
- Offerings/Terms of Service
GLOBALPRENEURS has the sole right to accept or reject orders for products and services, to establish and change without notice the prices of such products and services, as well as to establish the terms and conditions of their offering. GLOBALPRENEURS may also discontinue offering or selling any product or service without liability or obligation to GLOBALPRENEURS. GLOBALPRENEURS Distributors may only offer and sell services and products in accordance with rates, terms, and conditions established by GLOBALPRENEURS. All sales representations and activities must be in full compliance with all applicable laws and regulations. GLOBALPRENEURS distributors may use only those means of marketing and selling of services and products that are acceptable to GLOBALPRENEURS.
- Co-Mingling of Funds
GLOBALPRENEURS may terminate any Independent Distributor discovered co-mingling funds or operating a bank account in the name of GLOBALPRENEURS or any other similar name.
- Personal Usage/Purchases
An Independent Distributor is not required to subscribe to or purchase any product or service marketed by GLOBALPRENEURS. However, if an Independent Distributor chooses to purchase any products or services offered by GLOBALPRENEURS, he/she will be responsible for all billing when due. If an Independent Distributor becomes past due on any bill for services or products provided by GLOBALPRENEURS or by a company with which GLOBALPRENEURS contracts, GLOBALPRENEURS may deduct any amounts owed by a GLOBALPRENEURS Independent Distributor from any future bonus or commission payments. GLOBALPRENEURS reserves the right to terminate a Globalpreneurs Independent Distributor that is repeatedly past due in making payment for any GLOBALPRENEURS service(s) or product(s) purchased by the Independent Distributor.
- Unauthorized Contact
Under no circumstances is an Independent Distributor permitted to directly contact any supplier/service provider(s) with whom GLOBALPRENEURS contracts, unless it is in specific relation to a personal account the GLOBALPRENEURS Independent Distributor may currently have with said provider.
In the event that a Globalpreneurs Independent Distributor's customer is experiencing difficulties with a specific provider, please inform the customer to directly contact GLOBALPRENEURS or the appropriate provider of the service to resolve the matter.
- Territorial Rights/Conducting Business
Globalpreneurs Distributors can market services and products and sponsor new Globalpreneurs distributors in any county or state in the United States of America, or in any country, without exclusivity. GLOBALPRENEURS Distributors are responsible for knowing and adhering to all laws and accepted business practices in the United States of America or Country in which they are doing business.
- Marketing and Advertising Policy
- GLOBALPRENEURS Philosophy Regarding Marketing Materials and Events
GLOBALPRENEURS has developed an exceptional achievement and compensation system that is based on solid experience and knowledge. We have created marketing materials and activities to fully support this model. No other marketing materials or activities are necessary to become successful as a GLOBALPRENEURS Independent Distributor.
Therefore, GLOBALPRENEURS strongly discourages our Globalpreneurs distributors from creating and/or distributing any additional marketing materials. In addition, GLOBALPRENEURS strongly discourages the practice of monetarily profiting from any type of marketing event held by a distributor.
- Use of Globalpreneurs or "I SEE You" Identity and Branding
In addition to our representatives and employees, Globalpreneurs identity and branding is one of its most valuable assets and, therefore, must be protected at all times in order to maintain its integrity for all. As such, GLOBALPRENEURS distributors are strictly prohibited at any time or in any manner from representing themselves as having any other affiliation with GLOBALPRENEURS other than as a "Globalpreneurs Independent Distributor".
Also, GLOBALPRENEURS Distributors are strictly prohibited from using logos, names, trademarks, or other proprietary information belonging to GLOBALPRENEURS or its wholly owned subsidiaries, unless otherwise authorized by GLOBALPRENEURS.
- Cold Marketing in Customer Acquisition and Recruiting
GLOBALPRENEURS is a consumer-oriented marketing company that is focused solely on relationship, or "warm marketing" techniques. GLOBALPRENEURS strictly prohibits Globalpreneurs distributors from engaging in any "cold marketing" techniques at any time for purposes of customer acquisition. Cold marketing is defined as any promotional activity that is geared toward random individuals who have no personal, business, social, or informal relationship(s) with the Customer.
Examples of cold marketing include, but are not limited to, mass advertising, purchased leads, trade show participation to solicit customers, door-to-door selling, telemarketing, pamphlet distribution, auto phone dialer usage, etc. GLOBALPRENEURS also strictly prohibits a Distributor from paying for a customer's service, directly or indirectly, that is not a direct family member or close relative. In the case of non-profit organizations, there are times when this process is acceptable. Prior to paying for any other account in your organization you should contact Globalpreneurs and obtain permission on an individual case basis.
Furthermore, GLOBALPRENEURS allows, yet highly discourages cold marketing techniques for the purpose of recruiting other Globalpreneurs distributors, as these can be costly, ineffective, and highly distracting to an Independent Distributor's consumer-oriented marketing efforts.
The use of telemarketing and "speed dial" (random or auto dialing) for recruiting purposes is strictly prohibited. Refer to Section II G "Telemarketing, Random Dialers and Lead Generation Programs" for specific rules regarding these cold marketing techniques.
If a GLOBALPRENEURS Independent Distributor disregards GLOBALPRENEURS recommendation and uses cold marketing techniques in recruiting efforts only, then that distributor is responsible for adhering to any applicable laws, limitations, or regulations that govern such techniques, including the accuracy of all information presented. In addition, any materials, scripts, advertisements, literature, videos, audios, etc., used in conjunction with a cold marketing effort must strictly adhere to Globalpreneurs complete policy: "Development and Use of Independent Marketing Materials."
- Development and Use of Independent Marketing Materials
GLOBALPRENEURS, including its wholly owned subsidiaries, strictly prohibits Globalpreneurs distributors from creating, distributing, and/or using unauthorized marketing materials that include any GLOBALPRENEURS trademarks, logos, names, or proprietary information.
Marketing materials are defined as any printed, broadcast, or online communications, including, but not limited to, advertisements, brochures, videotapes, video files, audiotapes, flyers, banners, flags, web sites, telephone recordings, emails, video emails, presentation materials, apparel, building signage, etc. This refers to mass blast Internet marketing and does not apply to one-on-one video email marketing sent to specific individuals and groups in which a distributor has a personal relationship.
GLOBALPRENEURS strictly prohibits distributor-created marketing materials that
- Do not adhere to Globalpreneurs policy on use of logos, names, trademarks, and proprietary information;
- Make any specific references to Globalpreneurs products, plans, rates, or any component of our 3rd Dimension Compensation Plan;
- Make any claims or guarantees related to savings, rates, or pricing, either expressed or implied.
- Make any earnings claims or provide any hypothetical earnings calculations, either expressed or implied prior to a guest becoming a GLOBALPRENEUR Distributor.
- Represent GLOBALPRENEURS as an employment opportunity, either expressed or implied, unless approved in writing by GLOBALPRENEURS.
GLOBALPRENEURS will allow the distribution of distributor-created marketing materials that promote a presentation meeting or event, or are designed to pique interest and facilitate conversation for the purposes of recruiting only, provided that said materials:
- Websites, Links and Spamming
Globalpreneurs Customers may choose to utilize the Internet to promote their business via a web site. If GLOBALPRENEURS Customers choose to create their own web sites, they must clearly identify themselves as "GLOBALPRENEURS Customers/Distributors" in a prominent place on their sites, including the first or "home" page. In addition, these websites must strictly adhere to Globalpreneurs complete policy on "Development and Use of Independent Marketing Materials" (Section II D). All such sites must be submitted to GLOBALPRENEURS for approval prior to making them available to the general public. GLOBALPRENEURS Customers may, and are encouraged place links to GLOBALPRENEURS-owned websites provided that the representatives' sites strictly adhere to Globalpreneurs policy on websites as stated in Section II D, as noted above. Also, GLOBALPRENEURS reserves the right to mandate the removal of any links to GLOBALPRENEURS sites on representatives' sites that do not comply with the policies as outlined in Section II D. Representatives are prohibited from placing any GLOBALPRENEURS documents, forms, audios, or video content on their website unless, such materials are individually and specifically approved in writing by GLOBALPRENEURS. In addition, GLOBALPRENEURS strictly prohibits "Spamming," or the use of unsolicited e-mail messages or broadcasts. You agree GLOBALPRENEURS may immediately terminate any account which it believes, in its sole discretion, is transmitting or is otherwise connected with any spam or other unsolicited bulk email or video email. In addition, if actual damages cannot be reasonably calculated then You agree to pay GLOBALPRENEURS liquidated damages of $1 for each piece of spam or unsolicited bulk email transmitted from or otherwise connected with Your account, otherwise You agree to pay GLOBALPRENEURS actual damages. You acknowledge you have read and understand and agree to be bound by the terms and conditions of Globalpreneurs Anti-spam Policy, available here. Such terms and conditions are applicable to the use of all GLOBALPRENEURS Software and Services and are incorporated herein.
- Cash or Monetary Incentives
GLOBALPRENEURS, including its wholly owned subsidiaries, strictly prohibits GLOBALPRENEURS customers from offering cash or monetary incentives/promotions/prizes/bonuses to members of their GLOBALPRENEURS organizational members or customers as a method of influencing customer acquisition. This does not apply to your down-line of Customers. GLOBALPRENEURS encourages its Globalpreneurs Customers to promote customer acquisition and recruiting by adhering to Globalpreneurs specific sales model.
- Media Inquiries and Personal Appearances
On occasion, Globalpreneurs Customers may be contacted by members of the media as a source or subject for a story. If this contact occurs, Globalpreneurs customers must immediately refer such inquiries directly to Globalpreneurs Marketing Department.
Globalpreneurs Customers are strictly prohibited from representing GLOBALPRENEURS in any public media arena, and from using uncompensated media forms, including, but not limited to, news releases, articles, editorials, unpaid advertising, infomercials/advertorials, and television, cable, or radio program appearances to promote or publicize GLOBALPRENEURS or its products, except as approved in writing by GLOBALPRENEURS. Such requests must be submitted in writing to Globalpreneurs Marketing Department at least 15 days in advance of the media activity. This policy is necessary to ensure an accurate, legal, and consistent public image for GLOBALPRENEURS and its Globalpreneurs customers and distributors.
- Fundraising
GLOBALPRENEURS strongly encourages the marketing of the GLOBALPRENEURS opportunity to non-profit organizations as a method of fundraising. In the past, marketing to non-profit organizations has not worked well in most other types of person-to-person, network marketing products due to the nature off most products appropriateness to mass markets and compensation plans that require a full time professional in order to manage and maximize the advancement through the ranks of conventional types of pay plans. However, with the introduction of our "I SEE You" Phone and the extensive reach of our 3rd Dimension compensation plan, we now have possibly the most attractive non-profit fund raising product ever devised! The fact that that our "I SEE You" Phone is a replacement product for millions and millions of existing land line phones and our compensation plan requires no full time management to maximize its long term reach, we have a fantastic opportunity to create a long term permanent income stream for non-profit organizations unlike anything that has ever surfaced in past history! Since our "I SEE You" Phone only requires people to switch from a 19th century voice only phone to our new live HD video phone that does everything their existing phone can do plus add live video, and in most situations at a monthly savings from 25-50% the decision to switch is a real "No-Brainer" for the consumers and a win-win for the organization they wish to benefit. We suggest that our distributors offer to purchase a video phone for the organization they wish to sponsor and pay for it out of their pocket so the organization has absolutely no out of pocket expense. Then with the "I SEE You" phone on their front line of our 3rd Dimension Compensation plan let the non-profit organization have all it´s supporters purchase their phone directly from the Non-Profit´s web site. Since this creates almost the exact same income for the sponsoring distributor as the Non-Profit´s income the Globalpreneur distributor and focus his/her activity on assisting the non-profit in notifying their supporters of the opportunity to dramatically upgrade their communications at a lower cost to them and at the same time benefit their favorite organization with an income equal to approximately $1.50 per month for every referral they make payable doubling to infinity across seven infinity pay fields. This simply means if an organization only averaged placing one phone in service per month for the next year and every customer averaged the same, just one customer per month, the organization would be paid on 4,096 customers at approximately $1.50 each per month or over $6,000 per month in the 12th month. Can you imagine what this could be if the organization got several hundred people to switch their 19th century phones to 21st century phones and each person who purchased a phone obviously wants everyone they love and care about to have the same technology, the possibility of massive geometric growth is a total Win-Win for not only the users of the new "I SEE You" Phones but for the first time in history the customer is paid for telling everyone they know about what they discovered. The list of organizations where this concept is almost unlimited. Think about Religious Organizations, Community Service Organizations like Rotary, Civitan, Optimist, 4-H, Chambers of Commerce, both Public and Private Schools, and the list goes on and on!
When introducing the GLOBALPRENEURS opportunity to a non-profit organization, GLOBALPRENEURS distributors are responsible for advising the organization to discuss the tax implications of this type of business income with a professional tax advisor. The non-profit organization must be made aware that state laws vary and that some state attorneys general have guidelines that must be complied with. In addition, all state and federal non-profit fundraising laws must be complied with to the fullest extent of the law. Generally, the worst thing that can happen is this income stream may become taxable. But if given the opportunity to have taxable income or no income, which will they take?
- Purchases Materials
GLOBALPRENEURS advises Globalpreneurs Customers to be very cautious and well-informed consumers regarding any marketing materials not produced and distributed directly by GLOBALPRENEURS. We do not monitor the effectiveness of, endorse, or accept responsibility for any materials not created by GLOBALPRENEURS. We strongly advise against using any organization that promises to deliver large numbers of qualified customers to your website. Globalpreneurs customers who refuse to comply with Globalpreneurs Philosophy Regarding Marketing Materials and Events (Also refer to section II A, Marketing and Advertising Policy: "Company Philosophy Regarding Marketing Materials and Events") are solely responsible for adhering to applicable state and federal laws. The purchase of marketing materials is not necessary to be a successful GLOBALPRENEURS Independent Distributor/Customer. GLOBALPRENEURS has made an agreement with our service provider to allow any Globalpreneurs Customer to have a customized template designed and inserted in your system for a one-time fee of $250.00. As an independent Customer of GLOBALPRENEURS you are encouraged to use our video communication system to promote other businesses. An example of this would be a Realtor, who is a natural prospect for our business to help them create a source of residual income, who would like to use our "I SEE You" marketing system to promote their Real Estate business. They would simply purchase a custom template for $250 to use with their Real Estate business and pay only a one time set up fee of $129.95 their first month and $99.95 for our Basic system or $199.95 then $149.95 monthly for our Advanced Video Communication Complete System. It is clearly understood that this is an excellent way to recruit Realtors into our business model so they can get our complete video communication and marketing system to use in their Real Estate business. All types of conventional business owners will see this value for their existing business... not just Realtors. Our best value is our Customized Branding Package. - Further Limitations
GLOBALPRENEURS reserves the right to limit or disallow any marketing activities that cast negative aspersions on the integrity, truthfulness, and/or reputation of GLOBALPRENEURS. We strictly prohibit the use of our video system to promote any illegal or pornographic materials, hate mail or inflammatory content. All violations will be immediately subject to termination. It is understood that either party may terminate this agreement, for cause, by giving notice to the other party in writing.
- Events
GLOBALPRENEURS supports the practice of Regional Training Events, "GLOBALPRENEURS Saturdays", Business Opportunity Meetings, and Private Business Receptions, as they are valuable educational tools when conducted with both professionalism and integrity. The true intent of such events is to provide further education and further information-sharing opportunities on the GLOBALPRENEURS opportunity and guidelines/principles for success within this business model. Under no circumstances are Regional or any other type of meeting/training session intended to provide any additional income stream to those who are sponsoring the events, and must be offered as non-profit activities at all times. All plans and materials for Regional and "GLOBALPRENEURS Saturdays" should be submitted to GLOBALPRENEURS for approval, in conjunction with the current terms of hosting Regional/"GLOBALPRENEURS Saturdays," Regional/GLOBALPRENEURS Saturdays that do not receive prior approval will be considered as operating outside of Globalpreneurs training philosophy and will not be promoted or endorsed by the company in any manner. Attendance at GLOBALPRENEURS events is not a requirement for being an Independent Customer, nor a prerequisite for success in this business. Our business model is structured so a Customer can use only the Internet and our video communications systems to build their business and train customers with a simple and duplicatable business model. The use of our Complete Video Communication System to market our "I SEE You" Phone gives us an advantage over anyone else marketing this technology by conventional means... so take advantage of it! Our competitors call it an "unfair advantage."
- Remuneration
GLOBALPRENEURS reserves the right to seek reimbursement for any legal or operational fees or to pursue recovery for any damages, when such fees and damages occur as a result of any policy violation by a Globalpreneurs Independent Customer. GLOBALPRENEURS also reserves the right to recoup such costs from future commissions, or other payments.
- Status as an Independent Contractor
- Claims of Employment
Globalpreneurs Customers are independent contractors and not employees of GLOBALPRENEURS. The position of Independent Customer shall not be construed as creating a relationship of employee-employer, Customer, or joint venture between any participant, sponsor, and GLOBALPRENEURS. It is impermissible to assert or imply that an Independent Customer or prospective Independent Customer is or will be employed by GLOBALPRENEURS.
- Binding Arbitration
In the event a dispute shall arise between a Globalpreneurs Independent Customer and GLOBALPRENEURS as to the Independent Customers Agreement and/or the Policies and Procedures, such disputes shall be resolved through binding arbitration before the American Arbitration Association, pursuant to the Commercial Rules of Arbitration. The arbitration shall be held in Covington, Kentucky before a panel of three arbitrators, each side choosing one, with the third arbitrator mutually agreed upon by GLOBALPRENEURS and the Independent Customer. Kentucky law will apply to the resolution of the dispute, unless otherwise mutually agreed in writing by both parties. The award of the arbitrator shall be final and may be entered in any court of competent jurisdiction. This provision shall not restrict GLOBALPRENEURS from seeking preliminary or permanent injunctive relief in any court of competent jurisdiction.
- Contractual Obligations
All Globalpreneurs are responsible for any expenses that result from their business operation. Miscellaneous expenses include, but are not limited to, licenses or permits required to operate a business, legal fees connected with the use of a business name, telephone expenses, product advertising, etc. Globalpreneurs Customers shall not involve GLOBALPRENEURS in any contractual relationships relative to their businesses. Such contractual relationships include, but are not limited to, signing contracts, renting or leasing office space, or equipment, open bank accounts, secure credit, cash negotiable instruments, make purchases, or enter into agreements of any kind in the name of GLOBALPRENEURS. Such action is prohibited and cause for termination of Independent Customer status. Each Independent Customer shall hold GLOBALPRENEURS, its shareholders, Customer Owners, members, directors, officers, and employees harmless from any claims, damages, or liabilities arising out of any of the foregoing actions.
- Reporting Taxes
Globalpreneurs Customers are not considered employees for purposes of the Social Security Act, the Federal Unemployment Tax Act, Federal Income Tax laws, or any other laws governing employees. It is the Independent Customer's responsibility to make self-employment and income tax payments as required by law. As such, GLOBALPRENEURS does not deduct any taxes from any commission and/or payments. GLOBALPRENEURS will send a Form 1099 to all applicable GLOBALPRENEURS Customer Owners who earn $600 or more in a tax year. It is the Independent Customer Owner's responsibility to provide GLOBALPRENEURS with the proper Social Security Number or Taxpayer Identification Number. If the information that is provided is incorrect or if the Internal Revenue Service notifies GLOBALPRENEURS that the information for any GLOBALPRENEURS Independent Customer does not match their records, then GLOBALPRENEURS will hold all future payments from that Globalpreneurs Independent Customer until the matter is resolved.
- Business and Legal Entities as an Independent Customer Owner
- Companies
A sole proprietorship, Customer, Limited Liability Company (LLC), or Corporation may become an Independent Customer (Globalpreneur), subject to review and approval by GLOBALPRENEURS. However, no individual or legal entity may participate in more than one GLOBALPRENEURS Independent Customer Ownership position. Since the Globalpreneurs compensation plan is designed to pay out maximum performance bonuses for achieving higher and higher levels of achievement, it is not an advantage to own more than one Customer position. For anyone or a company to acquire a new Independent Customer Ownership, or to change their current representative status to a company, GLOBALPRENEURS must be notified in writing. Written notice is also required when changing an existing individual's representative status to a company. The following items are needed to apply for a GLOBALPRENEURS Independent Customer agreement with status as a company:
- The name of the legal entity;
- The Company's Taxpayer Identification Number;
- A list of all Customer Owners/shareholders/members with more than 5% ownership. The document MUST include the Social Security Number for each person listed;
- A completed Globalpreneurs Independent Customer Agreement, completed by an individual authorized to enter into binding agreements on behalf of the business entity.
- Trusts
An Independent Customer (Globalpreneur) can operate her/his Independent Representative business in the name of a trust. The person(s) that is (are) responsible for operating the business of the trust must be of legal age and cannot be another Independent Customer of an interest in another Customer or have an ownership interest in another Independent Customers status without written permission from GLOBALPRENEURS. To become a new Independent Customer Owner as a trust or to change an existing representative status to a trust, a current Independent Customer must submit written notification and a new Independent Customer agreement to GLOBALPRENEURS. The following items are needed in order to apply for the GLOBALPRENEURS representative status as a trust:
- A legal document displaying the name of the trust and a legal opinion from an attorney stating that the trust is in compliance with all state and federal laws;
- A document that provides proof of the trust's Taxpayer Identification Number;
- A document that lists all trustees, including the Social Security Number for each person listed;
- A completed Independent Customer Agreement, signed by an individual authorized to enter into binding agreements on behalf of the trust.
The person who submits the written notification must be authorized to enter into binding contracts on behalf of the trust. It is the Independent Customer's responsibility to insure that GLOBALPRENEURS has received all the documentation required to list the representative status as a company or trust. If GLOBALPRENEURS has not received the appropriate documentation within 45 days of establishing a Customer, then GLOBALPRENEURS may suspend the Independent Customer position until all of the documentation is received and processed by GLOBALPRENEURS. In addition, any commissions earned during the suspension period will be held until the matter is resolved.
- Marriage
A husband and wife may operate under the same representative position or independently. If the husband and wife choose to operate independently, then one spouse must be sponsored by the other. GLOBALPRENEURS reserves the right to ensure that husband and wife distributorships independently operated are correctly sponsored, as well as the right to make any necessary corrections to bring either/both Customers into line with existing company policy.
- Specifications for GLOBALPRENEURS Independent Customer Names
GLOBALPRENEURS reserves the right to approve or reject any representative's choice of business names, for the formation of corporations, LLC's and the formation of trusts, that are formed for tax, estate planning and liability purposes. If GLOBALPRENEURS approves such a change by the representative, the organization's name and the names of the principals of the organization must appear on the Globalpreneurs Independent Customer Agreement, along with a Social Security Number or Federal Tax Identification Number. Any request for a change in the name or a change in the Social Security Number or Tax Identification Number of the Globalpreneurs Independent Customers status is subject to a written agreement, signed by all parties involved, submitted to and approved by GLOBALPRENEURS. GLOBALPRENEURS reserves the right to verify all authorizations prior to making changes. In the absence of any agreement or notification, GLOBALPRENEURS will only recognize the individual whose Social Security Number was originally listed on the Independent Customer Agreement. Please note that GLOBALPRENEURS will only continue to service the Independent Customer who remains listed in our computer system. GLOBALPRENEURS reserves the right to intercede in disputes, and if it is determined that unethical activity exists, the status of any/a Globalpreneurs Independent Customer may be suspended and/or terminated.
- Identification Numbers
Each Member is assigned a unique identification number that identifies her/him as a Member of GLOBALPRENEURS. It is the Customer's responsibility to provide this number on the Independent Customer Agreement when sponsoring a new Independent Customer.
- Sponsoring New Members
- GLOBALPRENEURS Independent Customer Agreements
New GLOBALPRENEURS Customers must complete and sign an Independent Customer Owner Agreement or complete the new Member sign-up process on the GLOBALPRENEURS web site at www.GLOBALPRENEURS.com. Or www.MyGlobalHub.com only the new Member can complete the online Independent Customer Agreement. It cannot be completed by a sponsor on behalf of the new Member. Application fees can be paid by Visa, MasterCard, American Express, Discover, Pay Pal, check, e-check or money order. GLOBALPRENEURS does not accept postdated or third-party checks. The new Independent Customer or the sponsor can mail or fax a copy of the Independent Customer Agreement to GLOBALPRENEURS for processing. If the application fee is being paid by check, a copy of the Globalpreneurs Independent Customer Agreement must be mailed to GLOBALPRENEURS. The start date of a GLOBALPRENEURS Independent Customer is the date on which their completed Independent Customer Owner Agreement is entered into and payment is recorded at www.GLOBALPRENEURS.com. GLOBALPRENEURS assesses a fee for all returned checks. GLOBALPRENEURS reserves the right to set or adjust the start date of the Globalpreneurs Independent Customer Agreement to the date payment is received by the Company.
- Representation
GLOBALPRENEURS Customers shall make no claim or inference to prospective Globalpreneurs Customers as to the anticipated or actual income an Independent Customer might earn. GLOBALPRENEURS makes no guarantees of income, nor assurances of any profits or success. Furthermore, any profits or success resulting from activities as an Independent Customer will be based upon customer acquisition and the amount of services or products purchased by those customers. Any success achieved will be based solely upon the Independent Associates effort, commitment, and skills. Each Independent Customer understands that no Attorney General of any state, territory or other regulatory authorities ever reviews, endorses or otherwise approves any product, membership, or compensation program of any marketing company. As such, each Independent Customer shall make no such claim to a prospective GLOBALPRENEURS Independent Customer. In the event that a question arises concerning Globalpreneurs compliance with the law, any such question shall be submitted to GLOBALPRENEURS in writing. Globalpreneurs Customers shall make no false claims or misleading statements concerning these relationships and understand that if they do, their relationship with GLOBALPRENEURS may be terminated and all commissions and bonuses forfeited. Globalpreneurs Customers agree to indemnify and hold GLOBALPRENEURS and its shareholders, Customers, members, directors, officers, and employees harmless from all claims, damages, and expenses, including attorney fees arising out of actions or conduct in violation of the Agreement.
- Independent Customer Owner Disputes
GLOBALPRENEURS may or may not mediate any disputes between two or more Globalpreneurs Customers, if requested to do so by all of the parties involved in the dispute. GLOBALPRENEURS, however, reserves the right to review sponsoring practices. If GLOBALPRENEURS agrees to mediate any dispute, its findings shall be binding on all parties involved in the dispute.
- Changing Sponsorship
GLOBALPRENEURS believes in and maintains the maximum protection of the Independent Customer's relationship with his or her sponsor. Therefore, changing sponsors is strictly prohibited. An Independent Customer may join GLOBALPRENEURS under a new sponsor only after a period of no less than six full months from the date of resignation or no less than six full months after a GLOBALPRENEURS Independent Customer fails to renew or cancels their Customer agreement. All resignations must be in writing and delivered to GLOBALPRENEURS Corporate Office or submitted from the customers back office within the Independent Customers web site. GLOBALPRENEURS reserves the right to re-assign sponsorship if it is found that unethical or misleading practices were used by a Globalpreneurs Independent Customer.
- Maintaining/Changing the Status of Your Business
- Selling Your Independent Customer Owner Status
A renewal fee is charged beginning one year after the GLOBALPRENEURS Independent Customer Owner´s start date. The fee is charged to cover the Customer Owner agreement for a period of one year. If GLOBALPRENEURS does not receive the application and renewal fee on or before 30 days after the anniversary date, GLOBALPRENEURS will assume that the Independent Customer does not wish to renew his/her status with GLOBALPRENEURS; therefore deactivation of the position will occur, the forfeiture of any future bonuses, commissions or other payments from GLOBALPRENEURS. If an Independent Customer Owner decides to renew within one year of their renewal date, he/she must then fill out the renewal application and submit the annual license fee and create a new anniversary date. It is the Independent Customer's responsibility to ensure that GLOBALPRENEURS has his/her accurate and current address information. Renewal applications are available on the GLOBALPRENEURS web site.
